Protection Of The Full-time College Students’ Rights And Interests During Doing A Part-time Job

The paper is written about the protection of the full-time college students’ rights and interests during doing a part-time job. But there remains controversies on the identification and legal rights of the student as an intern, and the identification will be directly related to problems such as doctrine of liability fixation, distribution of evidential burden and so on in the lawsuit. Although doing a part-time job after studying has been greatly encouraged and advocated, there is no clear stipulation in the available legal system on the identification and labor rights of the student as a intern, which has led to lots of cases where the rights and interests of the student have been violated. When the infringement happens, the Contract Law and Tort Liability Law will be used to deal with the event, however, the protect level is obviously insufficient. So in order to protect the legal rights and interests of the student as an intern, some suggestions are proposed this paper, for example, make up the loopholes in the law system and improve the insurance system and the judicial remedy way.
