With the slowdown of China's economic development in recent years,employment of college students has become a problem troubling the society,and internship has become an effective means to improve college students' employment.College students can apply their theoretical knowledge to practice through internship to enhance their employment competitivenessNow will organise their students in colleges and universities to the fixed unit internship,this is the teaching practice,we usually say,however,with the development of the society,also appeared a variety of types,such as employment internship,paid internships,field work,etc.,and labor rights and interests of the college students in the process of internship of the damaged situation is often appear,because our country's legislation has not yet been internships for college students have a clear rules,lead to college students' rights and interests is damaged,unable to get legal protection.In addition,China's current law does not make clear provisions on whether the internship students have the labor status in the sense of labor law,and whether the relationship between university interns and internship units is a labor relationship.This has led to the phenomenon that the same kind of cases have different results in both theoretical and practical circles.The core of this paper is to protect the labor rights and interests of intern college students.To define the special worker status and the relationship with the internship unit;This paper analyzes the specific situations of the rights and interests of the intern students,including the difficult protection of the internship benefits,the arrangement of compulsory internship in the university,and the difficult relief when the rights and interests are damaged.The specific reasons for the damage of rights and interests include law,government,universities and students themselves.Finally,by referring to foreign advanced experience and combining with China's specific national conditions,we find the legal protection for the rights and interests of college students' internship labor,as well as other aspects of protection.
