In recent years, financial products the use of information technology has made considerable progress and changes in financial products and services are also increasingly rich and complicated. In the financial consumer relations, consumer facing financial information asymmetry, cognitive limitations, risks and other issues, and financial institutions can not be in relatively equal footing. State will protect the weaker party in an unequal position, through its system of tilt to achieve substantive justice. Regrettably,however, is that China’s "Consumer Protection Law" could theoretically be used to finance category, but the terms of the service consumer law is very rough, there is no way to achieve real deal aggrieved consumer rights demand. On the other hand, although our country has a large number of administrative provisions, but not equal to civil and commercial effectiveness of norms, rules can not be equated fragmented consumer protection rules in the financial system. In order to really make financial transactions between the two sides in substantive equality, sustainable development of the financial industry, it can be used in the form of legislation to protect the rights and interests of financial consumers.This paper is divided into four parts to describe, opening focuses on the concept and characteristics of financial consumers, in which the scope of financial consumers were defining characteristics of commodity and financial trading activities and discussed, after which the second part discusses the need to protect the financial interests of consumers.The third part analyzes the current situation and problems of financial consumer protection were discussed in terms of financial institutions, regulators, the existing system. The last part of the article, based on the above theory, referring to the experience of common law and civil law, to make our financial consumer protection recommendations implemented.
