Study On Income Distribution System From Constitutional Jurisprudence

Harmonious relationship between income distribution is the key point of a harmonious society. Thirty years of reform and opening up, China’s economic has made considerable progress development, people’s living standards improving rapidly. However, at the same time, social contradictions between strong groups and vulnerable groups continue to increase, the income gap between residents further expanded. These gaps in particular show in the following areas: the proportion of accumulation of wealth in government is increasing; the income gap between industries and between different groups is too large, and the situation is accelerating tendency; the rich are getting richer and the poor are getting poorer, middle class have to bear a heavy burden; resource elements distribute unfairly, capital allocation get too much, too little in labor allocation; monopoly industries income is too high. The expand of the current income gap is caused by a variety of factors, and this article attempts to explore the relationship between income distribution powers and rights from the perspective of constitutional law, prove that social distribution actually reflects the distribution of power in economics, analyzes the nature of the reasons of income distribution disparity is the absence,dislocation, and offside of public authority in the field of social distribution, which causes rights between strong and vulnerable groups in extreme imbalance. Finally the article proposes a solution by significant constitutional methods, through the rule of law and improvement of civil society to regulate public power exercised sort of public authority in a market economy and social distribution of the location, a significant civil rights, and improve citizens’ interests expression mechanism, thereby forming a fair and equitable market environment, strong balance interests of vulnerable groups and strong groups, ultimately solve the wealth gap, share wealth results.
