This study is conducted to introduce and analyze the legal action of police against the school violence In Korea. In December 2011, a middle school studen t in Daegu province of Korea committed suicide because of school violence. Wh ole country paid attention to the school violence, In spite of Korea Government actively established countermeasures, school violence is still being maintained.The concept of school violence differences by academic, and ’the Act on th e Prevention and Countermeasures against School violence’ comprehensively inclu des almost all actions that cause harm to students, including even defamation, fo rced errands, bullying and cyber bullying with injury, assault, blackmail, sexual v iolence. According to the Guideline for school violence published by Ministry of Education, This study classify into seven types of school violence.According to 2011 yearly report of The Foundation for Preventing Youth Vi olence, the proportion of respondents answering ’Yes’ to the question ’I have exp erienced school violence within the last year’ has grown to 18.3%, the highest fi gure since 2006, indicating that school violence has become severe. ’I was beate n’ was the most common response among male students, and ’I was cursed at or insulted’ was the most common response among female students. In particular, t he police report on youth gangs known as ’Iljin’ showed that they create an abn ormal school culture by using group violence.The school and the police mainly take legal action against school violence i n Korea. At first school takes legal action based on ’the Act on the Prevention and Countermeasures against School violence’. The school committee which is co nvened deliberate the case and determine the action for victim and assailant. Acc ording to committee’s decision, the principal take disciplinary action.Secondly the police takes legal action based on ’Police Act’, ’Criminal Law’ and ’The Juvenile Act’ against school violence. the Police intervene school violen ce for the prevention, the Investigation and legal action. According to the age of assailant and the gravity of crime, police takes different legal action including t he termination of internal investigation, police diversion, sending to prosecution f or criminal suit and sending to court for juvenile protective action.
