Study On Legal Challenge And Countermeasure About Maritime Compliance Of China Under IMO Compulsory Audit Scheme

The Chinese government has been really serious about the Chinese maritime compliance in order to realize their image on maritime. However, with the propose of IMO compulsory audit scheme in 2015, Chinese maritime also has shortcomings to face the new requirements. This paper is based on the research of the maritime compliance of IMO and compulsory audit scheme, to analyze the maritime compliance of our country, to get the legal challenges and draw lessons from other countries, to give advice to our maritime compliance. Except the introduction and conclusion, this has include four chapters.The first chapter is about the characters of compulsory audit scheme and the new challenges of our country. Mainly according to the literature and summarized the characters and requirements of compulsory audit scheme. To analyze the new challenges through the websites of Transport Ministry and Maritime Bureau.The second chapter is a detailed analyze of China’s current legal predicaments on maritime compliance. Mainly analysis from the activities of our country on maritime compliance’s forms, mechanisms, measures and safeguards.The third chapter analyze the maritime compliance on construction and implementation of many powerful shipping countries. Based mainly on domestic scholars and foreign literature about the United States, Australia, the UK, Japan and so on.The fourth chapter is about the advice on contribution of maritime compliance.According to the legal challenges and the foreign experience, to improve our maritime implementing legislation from the system, clearly known about the maritime agency’s duties, and to make up the FSC, PSC and coastal state regulatory measures.The main innovations of this paper is three: firstly, through the analyze of IMO compulsory audit scheme and their requirements, combined with the performance of maritime practice, finding the conflict between IMO and our country, thus put forward the specific countermeasures; secondly, to analyze many countries maritimecompliance from forms, agency, measures and safeguards aspects; thirdly, to conclude the countermeasures of our country’s maritime compliance.
