The Research Of Court Spokesman System Under The Perspective Of Social Identity

The Court trial is facing a situation of public’s query and public confidence force of judicature is coming down for recent years. The conflict between Litigant and Court Judges is getting more and more serious. Besides, the press and the public is always pay high attention to law cases with social influence. To build up judicial authority and get confidence of the public, the Supreme Court has attached great importance to construct system of Court Spokesman from last year. Meanwhile, the Supreme Court has published Court Spokesman’s name with contact information of national courts at all levels in order to make judicial get more transparency. But even though that cannot mean the Court Spokesman System has brought a good effect. In practice, the most Court Spokesman System is just a system in form, which not play its role. Although even if the court holds a press conference, it has a distance with the public. Above all, our Court Spokesman System remains to be perfected.Based on the social identity theory, this paper will try to research how to set up the Court Spokesman System. In author’s opinion, setting up the Court Spokesman System is the expression of communicating with social initiatively, and the goal is to deliver the correct court information to the public and communicate with them. Let every public can participate in the judicial process, and to be recognized about justice, improving the judicial credibility.The paper is divided into four main parts.The first part submits a question, by analyzing the social cases、investigation and research data and the implementation situation of the Court Spokesman System, the paper points out the necessary of studying and improving the Court Spokesman System based on the social identity theory; The second part includes chapter two and three, chapter two is mainly about the overview of the Court Spokesman System,; combined with the specific circumstances in this paper, chapter three analyzing the requirement of improving the social identity of judicial adjudication and the public participation program, putting forward the necessity of the Court Spokesman System clearly; As the part three, chapter four is mainly about the defects in the Court Spokesman System; Chapter five and six is the final perfect part, it puts forward some perfect measures of building the Court Spokesman System by analyzing the Court Spokesman System in Germany.
