A Study On The Deliberative Legislation Mode

As a paramount form of Socialism Deliberative Democracy, legislation consultation is the democracy activity as well as negotiation among the National People’s Congress, its Standing Committee, other legal subjects which exercise related legislative power and the certain or uncertain groups, during the legislative activities.In China, legislation consultation is not only the important embodiment of the Mass Line of the CPC during the legislative process, but also the significant move in democratic legislation.Meanwhile, it plays an important role in implementing the Sovereignty of the People Principle, supporting and ensuring people to exercise their legislative power through the national legislature.Based on the report of the Eighteenth National Congress of the CPC, improving the socialist consultative democracy is an important part of reform of political institutions. Furthermore, as an important part of the socialist consultative democracy, the legislative consultation has developed gradually in the legislative practice in many places. In order to garauntee that the legislative consultation can be carried on successfully and legally, According to the practical experience in many regions, there are two patterns in the legislative consultation which are mainly led by the the National People’s Congress and the Chinese People’s Political Consultative Conference. Comparing the legislative consultation practices in Dalian with which in Qingyuan, the essay considers that although the legislative consultation practices are different in many regions, they reach the following basic consensuses that legislation should be formed through negotiation of legality. It proves that to realize scientific and democratic legislation, the Chinese People’s Political Consultative Conference, people’s organization and general puplic should participate in the legislative work. It can not only improves the legislative quality but also helps gain the people’s understanding and support.
