On The Law Boundary Of Household Management On The Right Of Name’s Restriction

The name is associated with all of our life, it is also the basic component of personality right.In recent years, along with the rapid development of the economy, people become to pursuit the spiritual life a lot, there are more and more disputes over the right to name,people’s character of publicity and the contradiction between the household registration management system highlights the right to name the limit to exercise the importance of defining. Although the right of name as the basic rights of a citizen, they can decide how to use the them, but that doesn’t mean they can exercise it with out control.We will discuss from the beginning of the "Zhao C" case, the study of nature of the right of name the principle of limitation to the right of name,at last rules of the right of name’s restriction that household management authorities limit to should be established.This study is divided into the following sections:Part one : Firstly,introduce the case of “Zhao C”,secondly generalizes the controversial focus of this case as well as makes a legal analysis.Whether the “C” is kind of numerical symbols, whether the normative documents that the administrative organ based on can restrict the right of the citizen’s name,whether name as Zhao C could injure the public interests,the last part of the case from the focus on three aspects are analyzed.Part two : Heoreticaly interpretation on the Name of the composition, the concept of the right of name, features, content.Part three : It provides the three kinds of different theories about right of name ’s nature.It is a constitutional basic right and also a kind of privately civil rights.Then it analyzes the nature of Zhao C’s name.Finally discussed the basic principle of the restrictions on fundamental rights.Part four : On the basis of the third chapter, it analyzes the rules of the right of name’s restriction that household management authorities abide by.Including the naming restrictions as well as the restrictions of the changed name.
