Nowadays, a large amount of private capital has flooded into highereducation. Unlike the international practices, the cash is not donated to build schools,but instead invested in running schools with the intention of making profits. This desireis supported by Non-state Education Promotion Law of the People’s Republic of China,which ensure the validity of investors’ getting reasonable return.With the gradual clarification of property rights, right of control without doubt hascome into focus within non-state higher learning institution. Non-state higher learninginstitution is a kind of running schools by non-governmental sectors. As an independentlegal entity, the non-state higher learning institution goes the same with thoseenterprises in its asset structure and administration mode. As for the non-state higherlearning institution, right of control is comprised of the appointment and dismissal ofleaders of the school, the establishment of strategy in training, the infrastructureconstruction and so on. In a long run, it’s easy to put it that situation will not changewhere higher education industrializes.With the development of society, taking Xi’an Fanyi University for example, theolder funders of non-state higher learning institution retired in succession, which leadsto intergenerational transition. Taking Jiangcheng College in China University ofGeosciences for another example, full-fledged leadership brings about issues ofchanging the term of office. It’s strongly recommended to keep up with the space,formulate rules and regulations to guide the non-state higher learning institution’ssuccession in the right way and make the investors legitimately deal with the right ofcontrol.
