With the gradual formation of the manner and mechanisms by market allocatingenrollment in China’ higher education, with higher education changing from a buyer’smarket to a seller’s market, college students, as consumers, pay to go to school, theirlearning rights should be reasonably protected. College students’ subjective and rightconsciousness in learning was increasing, and they began to ask for replacement ofteachers, replacing the curriculum, providing quality learning environment.Meanwhile, the university also began to focus on the needs of this special group,advocating student-centered, focusing on the interests and perspectives from them,learning to solve problems related rights of them. Therefore, this article follows thislogical thinking:“to clear the problem—analysis of the problem—to solve theproblem,” uses literature, comparative study, questionnaire and case analysis, from theperspective of teaching activities, have a more systematic and deeper discussion aboutthe rights of college students. Specific content is divided into the following fivesections:The first chapter is an introduction, introduces the research background andsignificance, overviews the status and lack in relevant research of learning rights inthe domestic and overseas, and is the overall design of the paper. The second chapteris an overview of the college students’ learning rights, and elaborates the significanceof protecting the learning rights based on the definition of the basic concepts. Thethird chapter is the present situation investigation and analysis of the causes of collegestudents’ learning right based on the perspective of teaching activities, through thequestionnaire survey of college students and the interviews of teachers and andcombining relevant literature study, we concluded that the status quo the learningrights of the teaching activities of college students is not ideal. There is a majorcontradiction between the low effectiveness of the safeguards of the rights of collegestudents and a high necessity for right protecting. The reasons include the followingaspects: our country is lack of policies, laws and regulations to protect the study right; the university is lack of rules and regulations to protect the learning rights; teachersand university leaders is not focus on learning right and students’ rights awareness isnot high. The fourth chapter is the effective measures of foreign college guaranteeingstudents’ learning rights. It mainly summerizes that foreign colleges and universitiesgive students the full rights to choose, the rights of evaluating teaching, excellentlearning resources; what’a more, Foreign teachers take the students as the center,adopt flexible and diverse teaching methods and objective evaluate the performanceof students’ academic performance. The fifth chapter is the countermeasures tosafeguard the study rights of college students. This research suggests that the stateshould create a policy and legal environment to maintain the learning right, clear theauthority of university and strengthen legislation; Universities should be constructedto maintain the learning righrs system, should change management concepts, improvelearning rights protection system, perform information platform to build the perfectquality campus environment, step up publicity efforts of rights protecting, promote theconstruction of campus culture of rights, open up a wide range of activist channels;Teachers should change the traditional education, change concepts of education, go tothe marginalized, take student as the center, pay attention to reformation andinnovation of teaching methods and enhance personal individualized guidance;Students should learn to consciously safeguard the rights, not only have rightsawareness but also take practical behavior.From the perspective of teaching activities, research shows that the right ofcollege teaching learning process is more serious damaged, for solving the problem,we need depth analize the causes of damagment and draw useful experience for theprotection of foreign college students’ learning right and put forward relevantcountermeasures from the nation, universities, teachers and college studentsthemselves.
