Since the 1990s, the social status of teachers in China has been continuously improved. In 2003, "Private Education Promotion Law" was enacted, which provide legal protection to realize the rights of private school teachers. But in real life, teachers'lawful rights in non-government colleges in China are often damaged and lack effective protection, which has aroused people's concern and consideration.In this paper, the teacher's professional right which stipulated by"Teacher's Law " is the angle of view. Through the literature analysis and the interview, we have analyzed the present situation of teachers'damaged status. From the interpretation between the non-governmental college and teacher's legal relationship, we determine the teacher's legal status. This study has analyzed the problem which teachers right safeguard exists and from national,the non-governmental college, social as well as teacher to interpret the reasons. At last, we propose that some concrete countermeasures. The country speeds up the legislative process in law, strengthens the guidance management, standardizes the teacher's market in private colleges, and improves its social security system. The non-governmental college should consummate the internal management system, implement the user-friendly management, and improve teachers'overall quality. The society should change their idea, increase the propaganda dynamics. The teacher should strengthen the legal right consciousness and so on.
