Research On The Problem Of The Content Construction Of Modern University Statutes

Since entering the new century， the state thinks increasingly much of thedevelopment of higher education，and increases rapidly its investment in highereducation.The construction and development of universities is an eternal topic of anation. Since the3rd Plenary Session of18th CPC Central Committee，a obvioussignal sent by our government is the constant decentralization of government，meanwhile，universities get more autonomy，it is a very gratifying thing for thelong-term development of universities. The long-term development of universitiescannot do without the security of university statutes，they formulate the task and goalof the development of universities， interpret internal and external schoolrelationships，and as the “basic laws”of school，they are of great importance for thedevelopment of universities and the establishment of modern university system. Ifuniversity statute is a system carrier to guarantee the development of universities，thenuniversity spirit is the indispensable soul force of a university. Blending splendiduniversity spirit into the university statutes helps universities to work out a reasonableand scientific content of statutes，and contributes to promoting the reform ofuniversity education in our country and the establishment of the modern universitysystem.Therefore， to research the question of the content construction ofuniversity statutes based on the perspective of university spirit is of great importance.This article is divided into four parts. The first part is mainly to clarify thetheoretical problem of the content system construction of modern university statutesin the perspective of university spirit. Firstly，to understand the connotation，statusand value of modern university statutes；then，to understand university spirit and thecontent construction of modern university statutes， including the fundamentalconnotation of university spirit and the relationship between university spirit and thecontent construction of modern university statutes；at last，to make certain thestipulation and basic requirements of the content system construction of modernuniversity statutes. In part two，I refer to the problems and reasons in the formulatingof modern university statutes in our country，through careful study of the content ofstatutes，I find it insufficient in highlighting university spirit，the content constructionof statutes is immature，the technique to construct the content of statutes is notstandardized and problems like that，and afterwards，I propose the reasons. In the thirdpart，I refer to the experience reference of foreign content construction of modern university statutes，including analysis of the content system of university statutes ofthree foreign universities，and the summary of experience of their content system ofuniversity statutes. In the last part，I present the proposal of consummating contentsystem of statutes directing at the problems existed， firstly， to deepen theunderstanding and carry out the legal status of university statutes，secondly，toresearch scientifically and consummate the content structure of university statutes，then，to define rights and responsibilities clearly and clarify the power relationshipwithin and outside universities，and finally，to highlight the uniqueness of universitystatutes in accordance with tradition.
