The curriculum autonomy of the university is an important category of academic freedom and university autonomy right. The curriculum autonomy of the university enjoy a certain autonomy of courses within the statutory scope. In this study, the curriculum autonomy mainly refers to the autonomy of university on the public compulsory course. It mainly includes subjects setting, curriculum and content selection, textbook selection, teaching methods of autonomy of the public compulsory in the university. The court of justice of the380th Interpretation related to the curriculum autonomy of the university in legality in Taiwan region of China. It was believed that the curriculum setting and arrangement of the university shall be borne by the university based on the university autonomy and academic responsibility principle.In order to study the influence of the380th Interpretation on the curriculum autonomy, the way of guarantee the curriculum autonomy of the university and the academic freedom and University autonomy, this paper adopts the method of case study as a rational analysis to the court of justice of the380th Interpretation in Taiwan area, and the method of comparative to the common public compulsory course offered in the National Chengchi University, National Chiao Tung University, and the Tamkang University. Firstly, this article defines the curriculum autonomy in the university, and then discusses the relationship between curriculum autonomy and academic freedom, University autonomy. Based on that, the court of justice of the380th Interpretation in Taiwan area is analyzed. In the court of justice of the380th Interpretation in Taiwan area, the judges gave full play to the role of the review institution about unconstitutionality, and gave the curriculum autonomy for security in the constitutional level, then to safeguard the right of academic freedom and University autonomy. Further more, in order to study the influence of the380th Interpretation on the curriculum autonomy, the article makes the comparison between the National Chengchi University, National Chiao Tung University, and the Tamkang University in history, curriculum planning and the organization of the general education. In conclusion, the way to strengthen the protection of college curriculum autonomy is that firstly, in order to provide institutional guarantee for curriculum autonomy, guarantee the right of academic freedom on the Constitution. Secondly, perfect the legal system of higher education system, to regulate the relationship between the universities and government.
