Research On The Disputes In College Student Dormitories Management From The Perspective Of Rule Of Law

Students dormitories are the most important living space besides classrooms.With the developing of our socialist rule of law,the friction between collegemanagement power and student right intensified. Some phenomena including theweak legal consciousness of college managers,the lack of spirit of rule of law insystem design,the frequent occurrence of college violating students legitimate rightsetc existing inordinately in colleges.However,Chinese scholars haven’t paid enoughattention to this issue.The existing rarely works only focus on student rightsprotection and neglects the legal college authority,let alone the discussion ofreconciling the conflict between student right and colleges‘power.The author made aresearch on the disputes in college students dormitories management from theperspective of rule of law in order to establish a systematical and efficient resolutionmechanism.It is a subject of both theoretical and practical values.This paper utilizes some relevant theories of education,management,law etc forreference.It applies the methods of case analysis,classified analysis anddocumentary.The paper researches the currently existing management disputesinvolving students rights of person and property separately from the perspective ofrule of law.The whole article systematically illustrated the origin and significance of theresearch and made a comprehensive analysis on the correlational research status athome and abroad. It clarified the legal relation between students andcolleges,students’rights in dormitories,colleges’power and their extents ofcompetence. The article divides the disputes into two categories which involvedstudents rights of person and property.The author chose typical cases and borrowedthe settlement of disputes in science of law to analyze the origins of managementdisputes one by one.Some reasonable advice and feasible countermeasures were putforward to defuse conflicts as a whole.The interests of both sides in college studentsdormitories management should be balanced and the administrative behavior ofcolleges should be regularized. Colleges should set the concepts of administration bylaw and humanistic management. Dormitories management should strengthen thelegal sense and service consciousness in order to perfect the management systemwhich can protect students’legal rights and advocate harmonious communication.
