Endowment Insurance Legal System Research Of China

China’s population has been aging since the end of20th century. And this aging processturns to be obviously paced up in recent years.Owing to the aged tendency of population,decreasing fertility rate and smaller families trend, the demand of socialized old-ageinsurance and related services seems to be suddenly rising. People would be increasinglyworried about their senior life.The reform of socialized old-age insurance has been becamea national obsession, causing widespread concern and attention.In China, there are manytheoretical research of endowment insurance system in the economics and sociology fields.However, such study in law is lacked. Based on the analysis of the legal institutions systemof socialized old-age insurance and its history and present situation, this paper will providesome specific useful suggestions for improving the system in China.This paper is consisted by six chapters.The first chapter will introduce the background andresearch significance. It will include and review the present situation of relative studies,providing the methodology and ideas.In the second chapter, it will state the basis of legalinstitution of Chinese endowment insurance system, mainly focusing on the analysis of theprotection of human rights theory, sociology of law justice theory and the law economicresources allocation theory.The third chapter is aiming to illustrate the history of legalinstitution of endowment insurance system in China, and gives a further analysis onexisting situation and summarizes domestic achievements of the system.The forth partmainly talk about the existing problems of present Chinese legal institution of endowmentinsurance system, pointing that the lack of legislation lag, the endowment insurance to planas a whole level is low, the irregular fund supervision, dispute processing mechanism is notregular enough and so on.The fifth chapter expounds the typical foreign countries thereform of endowment insurance legal system, according to our country’s legal system of thepresent situation and the experience of the foreign legal system of endowment insurance,thus put forward our country enacted endowment insurance legislation, improve theendowment insurance to plan as a whole level, perfecting the financing mode ofendowment insurance system, establish an effective mechanism of endowment insurancefund supervision, some suggestions on establishing and perfecting the endowmentinsurance dispute processing mechanism. The last chapter is conclusion, summarizing thisstudy and pointing the innovation and valuation of this paper.
