Research On Legal Issues Of Investment And Operation Supervision Of Chinese Basic Endowment Insurance Fund

The effective supervision of the basic endowment insurance fund is an important means to control the investment risk of this fund,and ensure the fund’s value preservation and appreciation.Firstly,this paper mainly selects the problems of government supervision in the supervision and management of the entrusted subjects,information disclosure,and supervision function allocation under the investment operation mode of China’s basic endowment insurance fund,and analyzes the performance and causes of the problems;Secondly,this article Introduce two foreign pension fund supervision models,and analysis of the choice of pension fund supervision mode in the United States and Chile,it’s concluded that we should learn foreign experience and gradually introduce prudential supervision rules.The suggestion part of this article is put forward to the above-mentioned problems,The author believes that establish a special independent organization,the National Pension Fund Supervision and Management Committee,can improve problems of supervision;we should clarify the content of pension fund information disclosure,Such as the principle of information disclosure,the subject of obligation,the legal scope.Finally,Those above recommendations should be based on the law,we should enact the Regulations on the Supervision and Administration of Basic Endowment Insurance Funds.
