Preschool education, as a major component of basic eudcation, plays a fundamental and guiding part in promoting all-round and sound development of individuals, consolidating and improving the quality and effeciveness of compulsory education, and fully enhancing the national literacy. The cause of preschool education has been making great strides, though coupled with many problems, since China’s reform and implementation of the opening-up policy. Preschool education laws, as the most compelling social norm in regulating preschool education practices, are certain to play a unique role in guaranteeing and elevating the development of preschool education. Legislation has consequently become requisite to resolve problems in preschool education, boost sustainable development of preschool education, maintain an equal access to education, and make education ruled by law. There are, nevertheless, no exclusive, specific and nationwide laws made till now for preschool education in China, which leaves no laws to comply with when problems arise. Exsiting policies and regulations, at a low legal hierarchy, are comparatively weak in legal validity, less authoritative and binding, and even faulty and incomplete in many items. Consequently, it has become a pressing demand to speed up the process of legislating preschool education for its reform and development.The study on the legislation of preschool education can be categorized into the study of its legislative process and content, with the latter being the most fundamental and essential, and of great theoretical value and practical significance. The study, based upon defining concepts relative to the legilation of preschool education, probes into constitution system and detailed contents of preschool education laws through the analysis of theories and facts, and then analyses relative policies and regulations made since the reform and implementation of the opening-up policy, and finally presents advices to amend and improve China’s preschool education laws.The study, in detail, chiefly consits of the following chapters:Chapter one, the introductory part, mainly introduces reasons, purposes, contents of the study, as well as literature review, significance and researching methods.Chapter two eleborates basic theories on the legislation of preschool education. First, it analyses the connotation and denotation of the three concepts of preschool education, the legislation of it and the content of the legislation, to expound the nature of the three concepts and the domain that the content research belongs to; Second, it seeks the basic theories on which the content study is based, through the research on the three fundamental theoretical paradigms of the concept of subjective educational management, the modern theory of preschool education, and theories and approaches of jurisprudence.Chapter three analyses current situation and content of China’s preschool education legislation. First, it illustrates the necessity of legislating for preschoold education in China, and clarifies the emphasis and difficulty in the legislation of our preschool legislation. Second, it clarifies problems of existing polices and regulations and causes to them, through the content analysis of China’s preschool education legislation, so as to make strategies for the improvement more well-directed and effective.Chapter four develops strategies of amending and improving contents of China’s preschool education legislation. First, it provides grounds for China’s legislation of preschool education through the enlightenment and reference acquired after comparing ours to preschool education laws in the U.S., the Great Britain, Japan,Hongkong and Macau. Second, based on the analysis of theories and facts, it presents, from the two categories of systems and detailed contents, advices of amending and improving exsiting laws made for preschool education, as a legal guarantee for the reform and development of preschool education in China.
