On Complex Legislation About University Statute

With the development of Chinese University Statute, the voice of the legislation about University Statute is getting higher and higher. But in the existing researches, we can hardly find a research, which develops legislative programmes about University Statute. So, this research try to provide a concrete plan,and this plan need accord with Chinese situation. This research not only use longitudinal comparison to analyse the development process of University Statute and compare now with the past, but also use horizontal comparison to compare Chinese University Statute with the western countries’University Statute. Under this base, research western University’s experiences and learn it.This research includes 3 parts.The first part focus on the history of University Statute. Trace its source, research its development progress, reappear its original appearance in history. This part has 2 research routs. the first routs treat Chinese University Statute as the subjects. And the other routs treat the western countries’ University Statute as the subjects. By this way, this research aims to present the difference between China and western countries and prove the necessity of the legislation about University Statute. This text thinks, administrative system is till the main body in Chinese universities. And breaking this type of situation must establish a new operating system, which treats the University Statute as the core of the whole operating system.In the second part, to analysis the legal nature, legal status and Legal effect of the University Statute, and tries to put forward the articles of association of the University compound base on the Legal characteristic of University Statute. This paper believes that the effect of Legal effect of University Statute has been beyond the University walls, and the way to realize it is to legislation of the university statute to obtain the support of various kinds of authorities, the compound university statute is the university statute that from various documents of various kinds of authorities.In the third part, the legislative scheme of the compound university statute is put forward, and further determined the contents of the statute making body, the legislation body, the legislative procedure and so on. The entire legislative program is established in the framework of the exercise of the legislative system of our country at present, thinking of the actual situation of our country, to ensure the feasibility of the legislative program. This paper believes that the University Statute legislation is a systematic work, instead of a simple University Statute legislation without thinking. It must be considering the subject, the procedure and basic principle of the University Statute legislation, should also considering the creation of the environment, such as change the function of the competent department of education and to formulate matching laws and regulations and so on.
