A Comparative Analysis Of The Constitutional Texts Of Oxford University And Peking University

Currently, it is in full swing for domestic universities in establishing and completing their own university statutes. The statutes of university is essential in contemporary university institutional system, that is to say, a university can not be regarded as the real modern one without its own statutes. In addition, statutes play a role as charter for university which is important for their specific decisions, prosperous developing. Formulating the statutes is still in its childhood domestically, but it is mature for Oxford which is a representative in Western countries. Despite basing on the practical features, it is also necessary to absorb the valuable experience in western universities during the progress in formulating domestic university statutes, helping to maintain the advancement and scientificity of the statutes.The study chooses the university statutes of Oxford and Peking as its object and makes a comparison within text analysis and comparative analysis. With the help of aforesaid, the study tries to put forward policy suggestions to improve and perfect statutes in domestic universities. Through the analysis of data collecting, this study yields results that are presented in the following paragraphs.The study firstly clarifies the history revolution of the two statutes is very different. The developing of statutes of Oxford is a continuous progress with almost no gaps while the statutes of Peking has a break and is formed gradually in a long time. In addition, the study also finds that there are difference between their institution settings which fits their own facts and features.Secondly, there are differences in structures and subjects, university missions, the inner management institutions, the rights and duties of students and teachers between Oxford and Peking through comparison.Thirdly, after comparing, the study tries to the reasons resulting the similarities and singularities and finds out that the university functions and values which caused by higher education management system, higher education tradition and their ideology might answer the question.Finally, the study gives some suggestions through comparison including changing concepts and highlighting the characteristics, rich the contents and detailing the regulations, putting university liberty into practice and maintaining university missions, clarifying the duties of inner management institutions and perfecting the restraint system, protect the rights of teachers and their dominant role.
