The Research Of Autonomy In Running A University In The University Statute

Higher Education Law of the People’s Republic of China has already providedthat the University must have a university statute, but the number of university withits statute enjoying the Charter significance is very small among the more than2300colleges and universities in China. University statute stipulates the rights of collegein detail transferred by law, which guarantee the autonomy of running a university onthe basis of the procedure and content. Through their own regulations, the universitycould deal with the relation among itself with government and the society; andmanage inside affairs, thus standardize the government’s management for theuniversity in order to avoid excessive intervention against the autonomy in running auniversity. So this article attempts to study in the autonomy in running a university inthe university statute, and analyze the situation, and compare with the foreignuniversity charter from the point of administrative law to promote the protection ofthe university statute of autonomy in running a university. Finally, the author willpropose suggestions for autonomy in running a university to implement and improverecommendations in order to fully implement the autonomy in running a university inChina.This thesis is divided into four chapters. Chapter1is an overview of theuniversity statute. Firstly, author will introduce the university statute from the definitions, characteristics and content. Secondly, it introduces the problems of theformation and the development of the university statute. Finally, is the study of thenature of the university statute, as well as the effectiveness of the government, otheruniversities and other social subjects. Chapter2is the value of universitystatute in the autonomy of running a university. Through the analysis of the relationsbetween autonomy of running a university with university statue, as well as ourcountry’s stipulation in this regard in a perspective of constitution and administrativelaw, so as to arise the conclusion that the university statute has a fundamental legaland protecting function for autonomy of running a university. Chapter3is the currentstatus of the autonomy in running a university. Author uses a sample text analysismethod, and come to the conclusion of reason for incomplete implementation ofautonomy and its reasons. Chapter4is to promote the implementation of autonomy ofthe university by the university statute. Through the divisionof powers between the government and university boundaries, the authorclarifies the relationship between the main body of Colleges and Universities, andthe relationship between the university and society in order to implement theautonomy in running a university.In this paper, the autonomy in running a university in the university statuteis a new perspective on the autonomy in running a university research, which isalso the author’s further study and research direction.
