Research On Application Of Labor Law About Professional Football Player

Chinese professional football started later and develops more slowly than other countries.Compared to western countries with developed football, our football are far from satisfactory, whether in rules of professional football, the level of athletic ability or capabilities of wealth creation. At the same time, we should also notice in the overall environment, which is not ideal, the protection of rights and interests of professional football players are not satisfactory, and sometimes the wages of them are defaulted.In order to further improve the level of professional football, it is necessary to maintain rights and interests of professional football players better. Because football players are the most basic practitioners in this industry, where there is a real professional football player, there is real professional football. Professional football players are in the scope of workers, thus the "Labor Law of PRC" and the "Labor Contract Law of PRC ", as a basic law of safeguarding rights and interests of workers, should play their important role in the field of professional football, in order to maintain rights and interests of the labor and regulate the industry's operation.After all, professional football is different from other industries, and the particularity of it decides that sometimes it is not suitable for direct application of labor law. After modifications, laws can be better integrated into the football field. As an independent industry, the scope of football industry involves all aspects of regulatory law. But according to the degree of Chinese labor laws fitting professional football industry, we can divide it into three types-directly application, application after complement, and no application.This article selects three typical aspects, and analyses them. In designing the transfer system, we should establish a model which is suitable to football's development, on the basis of law of value, and it can't be adjusted by labor law. In life security of professional football player after their retirement, we should strictly implement the relevant labor laws. On the question of settlement of labor disputes, we should respect the basic spirit of the labor laws, and modify the relevant laws, in order to guarantee the stable and healthy development of football industry and safeguard the legitimate rights and interests of the football player.We hope that through the problem, we can have a deep understanding of the value of labor laws and professional football's own rules, and explore the development road of professional football under the spirit of law, which are helpful to better regulation of football industry and relevant legislation in professional football field.
