In late twentieth Century, with the rapid popularization and application of high and new technology, the industrial structure of each country is also adjusting and upgrading. One of the most notable features is that the proportion of the third industry in the national economy continues to expand. The huge change of the industrial structure put forward new demand to the employment form, and the non full time employment in this kind of environment arises at the historic moment. Non full-time employment, with its flexible characteristics by countries around the world to promote. Similarly, the labor form in our country has also been rapid development. With the upgrading of the industrial structure of our country, labor market competition is increasingly fierce, full-time employment with the characteristics of its flexibility by enterprises and workers favored and widely distributed in restaurants and supermarkets, service type establishments. So that the proportion of part-time workers accounted for more than half of flexible employment. In order to better regulate the new labor relations. In 2007, China’s introduction of the "labor contract law" from the law in the form of labor to make provisions, which also marks the part-time employment to get recognition of the law of our country. However, this method only uses five provisions to make the corresponding regulations, which can not adapt to the rapid development of the labor market in China. Moreover, the part-time employment in our country as a new thing, and its corresponding legal norms are still relatively lacking, resulting in the legitimate rights and interests of workers is very easy to be damaged and can not be based on the embarrassing situation. Therefore, we should perfect our country’s non full time employment system as soon as possible, and effectively protect the legal rights and interests of part-time workers. This paper mainly from four aspects on how to improve the non full time employment system in our country were explained and studied.The first part is an overview of the basic theory of the non full time employment system. This paper mainly introduces the concept, characteristics, and the reasons for the rise of the employment form, and points out the significance of the development of the form of part-time employment in our country.The second part is the introduction and analysis of the status quo and existing problems of the non full time employment in our country. First, through to the local food and beverage industry visits and research analysis introduced our country non full time employment system status, also about employee working hours, labor income and insurance payment are analyzed, points out the issues China non full time employment system, and the relevant laws and regulations of the problems on the basis of.The third part is mainly to foreign countries and organizations related to the non full time employment legislation practice are presented and analyzed. It is pointed out that the non full time employment in the area above the development benefits to governments with strong encouragement and support, and the equal protection principle to carry out the legislation, form to complete the non full time labor legal system, it is of important significance to improve the relevant legal system of our country.The fourth part is to perfect our country’s non full time employment system put forward suggestions. Including: at the legislative level should pay attention to non- full-time employment system development, equal protection principle to carry out the non full time employment system, and improve the non full time employment system in the contract conclusion and termination, the wage and hour as well as social insurance system on this as the core. At the level of law enforcement, it is necessary to further strengthen the supervision and management of the forms of part-time employment. In the labor level, should further develop and improve their qualities and the ability of self protection and so on.
