Research On The Difference Of The Treatment Of Industrial Injury Insurance

The operation of enterprises promote the development of economy,and labourers are an import force that can be not ignored. Industrial injury insurance is not only to ensure occupational safety, timely give economic compensation, but also to disperse the employer’s work injury risk, play the role of safety nets and shock absorbers. Recently there are a large number of difference of injury insurance benefits, which affecting the development of injury insurance and the rights and interests of workers. If the issue is not handled by social security agencies and the courts properly, then it will lead to contradiction between labor and workers, and even the group conflict. This paper selectes some cases, and combines local practice of laws and regulations and scholars focus of controversy,which in order to provide preliminary discussion and suggestions for solving the problem.Firstly,the paper elaborates current situation of difference of injury insurance benefits through analysis in the laws and regulations and cases, then further analyzes the reasons for the differences, such as the law and regulations is unknown, the bases of social insurece decared by enterprises is not real and lack of supervision of social insurance institutions. Secondly, it compares and analyzes different solutions to the problem, which is the focus of controversy: the standard calculation of wages and main responsibility for the difference of insurance treatment. And this paper also explains advantages and disadvantages of different options. Thirdly, it offers preliminary proposals to solve the problem based on local practices. To avoid the difference of treatment,it is necessary to legislate to clear the standard of wages and tax authorities to unify collect and check industrial injury insurance. Faced with this difference treatment, employers should pay supplement insurance, social security institutions need to reissue treatment of non-time payment account balance and our country should strengthen all aspects of supervision. I hope this paper can provide some useful suggestions to research on settlement of the difference between the treatment.
