An Analysis Of The Cause Of Juvenile Delinquency And Its Countermeasures In Lengshuijiang, Hunan Province

At present,juvenile delinquency has become a very serious social problem.As a judge working at the grass-roots level,the author has a frequent contact with the juvenile delinquency.It is significant that more attentions should be paid to the analysis of its cause and its countermeasures.In this thesis,many law cases of the juvenile delinquency in recent years from the Lengshuijiang Court,where the author of this paper is employed,were investigated and analyzed.The study presents that a significant rising trend has been found in the city’s juvenile delinquency. The wealth crime,the violence crime and the prejudice to the social order are the main components of the investigated cases.Furthermore,many other phenomena are also very prominent,such as the higher frequency for common criminal cases,the juvenile delinquent without the high level of education and coming of the unemployed or even of the students at school,the male holding the absolute majority and so on.The study also found that several main reasons should be responsible for the causes of juvenile delinquency occurred in Lengshuijiang,which including the psychological characteristics of minors,the lack of family education and the school education,as well as the adverse effects from the network.Moreover,the rising unemployment rate in the city,the number of children left having been increased,the deterioration of society, and the widening gap between rich and poor,are also thought to be closely related to the city’s rising crime rate by the juvenile delinquent.As a result,the paper put forward the different countermeasures for the family,the school,the community and the judiciary to reply for the serious situation of the juvenile delinquency.From the different point of view,such as the investigation phase,the prosecution phase,the phase of the trial and the penalty phase,the study suggests that the right of a minor suspect’s legal representative on the spot should be protected,and that the defense lawyers could have the right to intervene in advance,and that the fine punishment might be relocated,and that the range of reducing a penalty could be increased and so on,in order to improve the judicial protection for the juvenile delinquents...
