The Research On The Rural Share-based Cooperative Reform

The rural share-based cooperative reform of the rural collective organizations is a mode of the rural collective reform, property right system also is a rational choice of the current reform of the rural collective economic organizations’ property right system. From the perspective of the rural collective economic organizations’ property right system reform, the article analyzes the state of the rural collective economic organizations’property right system, studies the necessity of the reform, it’s development trend and realistic path——share-based cooperative system. Based on the analysis of the current situation of the rural share-based cooperative reform, the article put forward some countermeasures and suggestions on how to improve the development of the rural collective economic organizations’share-based cooperative reform, in order to promote the rural collective economic organizations’property right system reform.Through the research, draw the following conclusions:The first, the rural collective property right is not a efficient property right form, can not respond to its members’ voice to share property rights, cannot produce due incentive effectiveness of property; organizations of rural collective economy in vain, their powers were largely grabbed by rustic governments, as the rural social managers, the rustic governments actually control of the rural collective economic organizations’ all assets, witch will be easy to cause the rent seeking of power. Under the circumstance that the relation of ownership between the members of the collective and collective asset is ambiguous, rustic cadre has increasingly become the master of collective economy, rural collective economy faces into economic risk from cadre. Accordingly, it is necessary to undertake the property right system reform of the rural collective economic organizations.The second, on the marx’s view of property right, according to the North’s theory of institutional change, the article analysis analyzes the development trend and realistic path of the rural collective economic organizations’property right system reform. For the property right system reform of the rural collective economic organizations, there are different changing routes between two different types of collective assets:the nationalization of resources, for example, land; the privatization of other collective assets. While the form of property right organization tends to be joint-stock company. But the property right system reform of the rural collective economic organizations can not develop in one step, the share-based cooperative reform has the stage characteristics of rural collective economic organizations’ property right system, and it is the rational choice for the reform of the present stage. Additionally, the deepening development of the share-based cooperative reform must follow the evolutional path of the rural collective economic organizations’ property right system.The third, through the analysis of the status quo of the share-based cooperative reform, which is the realistic path of the rural collective economic organizations’ property right system reform. Through the checkup, quantification of rural collective assets, and establishing the corresponding distribution system, decision making mechanism, governance structure and other measures, the share-based cooperative reform has changed situation of the original rural collective economic organizations, to some extent, of which the property right is not clear, the right to operate is independent, management is not democracy. But, the reform has not touched the foundation of the rural collective system of ownership——the rural collective land, and has a conserved features, did not finish the task that to clear property right thoroughly, so, share cooperation organization obviously has a lot of characteristics of original rural collective economic organizations. In addition, the whole law level to regulate share-based cooperative reform is not high, there are a lot of problems, such as, the vacancy of benign unconstitutionality boundaries, lack of relevant laws and regulations, ineffective implementation of legal norms.The fourth, according to development trend of the rural collective economic organizations’ property right system reform, combining with the existing problems during the share-based cooperative reform, the article put forward countermeasures to solve these problems. For example, to clear the property rights more thoroughly, break down the closed share-based cooperation organization gradually, deepen the reform to separate share-based cooperation organizations from administration, in order to make sure that the rural collective economic organizations are independent economic entities. In addition, to improve the legal levels of the share-based cooperative reform, and regulate share-based cooperative reform thoroughly.
