| The renewal of old urban areas is a major feature of our country’s rapiddevelopment of urbanization and industrialization, and the expropriation ofhouses is indispensible here. The renewal of old urban areas is grand in scalewith a concentration of projects, which makes house expropriation the focusissue of social stability and development. Compensation is the core of theissue. However, due to some problems in China’s current compensationsystem on house expropriation, the expropriated have not received adequatecompensation. In my opinion, to solve problems in compensation on houseexpropriation, what should be clarified are basic principles, exact scope andspecific criteria of the compensation so as to scientifically distribute theappreciation of the land. This is of fundamental importance for theestablishment of a reasonable and effective house-expropriation compensationsystem.First, in this essay, terms of expropriation, house expropriation, publicinterest, the right to the use of state-owned land are defined. What isexplained through the meanings of these words is that the nature of theexpropriation of houses on state-owned land and compensation is the recoveryof the right to the use of state-owned land. Based on on-the-spotinvestigations and case studies, the current situation of the implementation ofhouse expropriation management and regulation system in Xilinhot isanalyzed. After a study of problems in house-expropriation compensation,shortcomings and inadequacies in construction of house-expropriationcompensation system are discussed. Next, through an extensive reading ofdocument literature and a study of effects of the implementation of“Regulation on the Expropriation of Buildings on State-owned Land onCompensation†in Xilinhot, theoretical, factual and legal foundations forcompensation on the right to the use of state-owned land in hose expropriationare listed. From aspects of compensation principles to scopes to compensation criteria, problems in carrying out compensation activities are explored. Therelationship between houses and the land is clarified, a path to appropriatecompensation and scientific distribution of the appreciation of urban land isfound, and solutions to interest conflicts are proposed. On the basis of all ofthese, strategies are proposed on constructing compensation system on houseexpropriation on state-owned land which assists a healthy urban constructionand improves urban land using structure. These all point out a way to improvethe work of house expropriation in urban areas. |
