Research On Development Of Intellectual Property Insurance In China

Knowledge is the first factor of production in the era of knowledge economy. It is an essential means to enhance the competitiveness of enterprises by using intellectual property in the new economic era.And intellectual property ownership are important indicators of measuring a country’s comprehensive competitiveness. However, as people know more about the tremendous commercial value of intellectual property, the risk of infringement are exacerbated. Given the domestic and international situation, intellectual property disputes continue to climb. People generally choose judicial means to resolve disputes, but the cost of rights protection is high.It would be an unbearable financial burden for some companies.So intellectual property insurers emerged and developed in USA and Europe which have a large number of intellectual property. It combines the intellectual property with financial means and shares the risk of infringement of intellectual property rights by insurance companies.It opens up the new thoughts on intellectual property management. Intellectual property insurance is generally divided into intellectual property enforcement insurance and intellectual property infringement liability insurance. They can meet customer needs from both offense and defense. In China intellectual property insurance has just started, both theory and practice have yet to be discussed and developed.Firstly,this paper analyzes the risk of intellectual property,its insurability and importance of intellectual property insurance from the macroscopic and microscopic aspects.Then,on the basis of in-depth understanding of China’s intellectual property insurance status,I discussed the main obstacles of development of intellectual property insurance from the angle of the demand of insurance, loss ratio, professionals, legal environment, and management of insurance companies. I further gave a summarization and analysis about the U.S., UK and EU intellectual property insurance system and drew inspiration for the development of China’s intellectual property insurance. Lastly,I proposed the related countermeasure of development of intellectual property insurance in China from the angle of coverage and pattern selection, operation and management of insurance companies, the government and technology-oriented enterprise.
