Study On Process Change To People Who Struggle To Safeguard Their Legitimate Rights And Interests In Urban Houses Expropriation

Since the reform and opening up, Chinese economy and society develop rapidly,city construction continues to expand. Because of the scarcity of land resources,especially the scarcity of high quality land resources, governments inevitablyexpropriate houses of urban individuals and units to obtain space of development. Dueto the lack of laws and regulations and procedural fairness, the transformation ofgovernment functions is not in place and complex interests, the lack of relatedresearch and effective theoretical guidance, lagging behind of communicationplatforms and the lack of regulatory mechanism, there often occur intensecontradictions in the process of houses expropriation, accompanied by demolitionstragedy.In fact, as one of disadvantaged group, the expropriated, who struggle tosafeguard their legitimate rights and interests, usually have something to tell to protecttheir legal rights during the houses expropriation. There exist essential differencesbetween the people who struggle to safeguard their legitimate rights and interests andnail household both in connotation and nature. The two also have relevance, if thecore interests of the people who struggle to safeguard their legitimate rights andinterests have not been listening to and solved timely, the latter may change into theformer with fierce protest behaviors. Based on analysis of connotation and property ofthem and argumentation of their legitimacy and rationality of existence, this articlefocuses on the transition process. The result shows that this is a dynamic group,changing with psychology, thought and behaviour during the expropriation andcompensation process. If excessively，there will appear nail household or extremeevents. Therefore, the government should pay close attention to the characteristics ofthese features, resolve the contradiction of expropriation compensation reasonablywith buffer zone principle，in order to expropriate successfully and harmoniously.
