On the surface farmers merely lost their land, However, due to the problems of the current land acquisition compensation system and limited by their economic capacity, Land- lost Farmers pension insurance rate is relatively low, and can not enjoy unemployment, retirement, medical insurance, As a result,they become a social group with “no land to farm, no post, no Subsistence allowances,called “Three no staff”. Land- lost Farmers become a vulnerable group. The damage to legitimate rights and interests of Land- lost Farmers not only hurt the farmers, but also hindered the process of urbanization. Therefore, the study,for protecting the rights of Land- lost Farmers has great practical significance.This article first proposed although national land acquisition let the farmers lose their land, but should not let Land- lost Farmers lose their land-based legal rights. The legitimate rights and interests of comes from economic functions and social security functions of their contracting and management land, and Farmers’ land can give farmers property income, a stable job, and protect their basic living and the related political rights. So, to solve the problem of Land- lost Farmers can not rely on just compensation to the point, and then simply resettlement by the old way, instead,should start with the legitimate rights of Land- lost Farmers, on the basis of clarifying which legitimate rights and interests Our laws and institutions entrust Land-lost Farmers,to discuss how to protect the legitimate rights and interests of Land- lost Peasants. Only the legitimate rights and interests of Land- lost Peasants fully protected, will the national land acquisition not cause the plight of Land- lost Farmers. In order to explore how to protect the legitimate rights and interests of the Land- lost Peasants, this paper,combined the city of the Hanchuan in Hubei province land acquisition practices, identifying problems from practice analysis, ties to build a safety network for protecting the legitimate rights and interests in a small areal,for building a national security system of the legal rights and interests Land- lost Farmers to provide valuable suggestions. The author’s idea is as follow. From the analysis of the legal rights Land- lost Farmers, combined with the cases of Hanchuan city,Hubei Province, analyzing current situation of legitimate rights and interests of Land- lost Farmers and its influencing factors, Finally, in a profound analysis of the reason of the legitimate rights and interests of Land- lost Farmers damaged, Combined with China’s basic national conditions and socioeconomic status of Hanchuan city,to propose safeguard measures for protecting the legitimate rights and interests of Land- lost Farmers.
