Research On Problems Of Intellectual Prop Erty Pledge Financing For Science And Technology Enterprises

Since the21st century, under the encouragement for the development of privateeconomy, private economy in our country’s gross national product (GNP) occupies a veryimportant position. According to data of GDP, in2013, private economy exceeds thestate-owned economy on the contribution to GDP, accounting for62%of the grossnational product (GNP). The rise of private economy adds vigor to the economicdevelopment of our country. But private economy mainly consist ofmedium-sized andminitype tech-enterprise as the main body, it is not running in a very smooth way. Ssuchproblems as shortage of funds happen a lot, because of the small and medium-sizedenterprise scale, limited capital,it is difficult to loan much fund from state-owned bankswhich severely restrict the development and expansion of enterprises. According to theinvestigation of medium-sized and minitype tech-enterprise, although a lack of enoughmaterial, but it often has the advanced technology, patents and copyright and otherintellectual property rights, particularly in the computer programming technologycompanies.Through the investigation and research of foreign countries, in2006, manypolicies are made to help enterprises to solve the problem of financing difficultythroughintellectual property pledge.Since the open policy has been carries not very long, fund-raising throughintellectual property pledget in China is not very mature, the relevant legal policy is notvery standard and perfect, and there are many places to be further improved. In this paper,through the literature survey, the enterprise interviews and other research methods, a deepstudy on the pledge system, running environment of medium-sized and minitype tech-enterprise and the present situation of our country is done.There still exists inadequatelegal provisions and ambiguous value assessment in the process of mortgage ofintellectual property rights in China. The study directs the way to law reform andimprovement for our country. Finally the paper points out the problems at the presentstage in China and puts forward some operational suggestions from the view ofstrengthening government guidance, system of relevant laws to improve the pledgefinancing transactions, identify relevant authorities to evaluate the market value ofintellectual property. The research is significant for improving the operation of theintellectual property pledge financing environment and ensuring fairness in the process of trading.
