On Resolution Of The Policy Bank’s Commercialization

With the development of the economy and the reformation of the social system, we have already formed the banking pattern with the policy bank and the commercial bank together. In this procedure, however, the three policy banks: China Development Bank, Export-Import Bank of China and Agricultural Development Bank of China, have been set and run for more than ten decades, conflicts between the two banks expand fiercely. That is to say that when the policy bank becomes the support for financial system of China, relative legislation and justice practice slow down its development. Without Law, the policy bank can never find a way to be strong. Meanwhile the instability of the banking directly affects the finance in China, and then affects the economy of China. So, it means a lot to handle conflicts between the policy bank and the commercial bank well.To push the policy bank’s commercializing, and to perfect the financial system, the author tries to study by comparison historically and broadwisely. Besides elaborating the present situation of the policy bank, getting to the predicament, and finding the causes, the author hopes to apply countermeasures to solve the conflicts between the policy bank and the commercial bank.In this paper, the author adopts value analysis method, logical analysis method, and comparative analysis method. Starting from finance, economics and legal angles of view, the author discusses the problems and countermeasures of the policy bank’s commercialization.There are five chapters in this paper. The first chapter is introduction, introduce the background, the status and the content of this paper. The second chapter is about the trend of running the policy bank. It is an overview of the policy bank, combining case studies, and the outline the policy bank’s commercial operation trends. The third chapter is the plight and causes of the commercialization of the policy bank, specifically analyzing three plights:the policy bank’s legal position is vague; management mode and market operation is poor; legal constraints and legal supervision is lack. The fourth chapter part is the countermeasures for the commercialization of the policy bank. Firstly get the experience abroad,combined with actual situation in China, and clear the policy bank’s legal status, finally apply the proposition of the management mode, including its organizational structure, its personnel system and its business scope, so that we can strengthen our legal regulation for the policy bank. The fifth chapter is the conclusion.
