As a kind of natural resources, land is not only the material foundation to the survival of humans, is more important economic function and social security function. Along with the constant deepening of industrialization and urbanization in our country and propulsion, the defects of the system of collective land ownership laws increasingly outstanding, these defects prevented the transfer of collective land, has affected the rural construction and urbanization in our country, restricts the economic development and social progress in our country. Based on collective land for rural construction, the influence of urbanization construction, with the aid of theoretical tools such as law, economics, the defect of legal system of collective land ownership in China is analyzed, the concrete research content is as follows:Based on the theory of our country’s legal system of collective land ownership, this paper introduces the connotation of the collective land ownership and the development course, summarized after three big changes of the current legal system of collective land ownership. This paper expounds the current construction of rural collective land ownership system and the positive and negative effect of urbanization construction. By analyzing these impacts the flaws of the legal system of collective land ownership in our country at least in five aspects, namely the main body is not clear, lack of power, decision-making mechanism of rigid, lack of time limit and compensation mechanism is not perfect. Aiming at these defects, this paper puts forward two kinds of perfect law and policy. Among them, the approaches of law are to modify the land administration law, develop the rural collective land circulation law and modification of other relevant laws; Policy approach is mainly refers to advance the collective land market and perfect the supporting policies in urbanization process.
