Study On The Protection Of The Farmers’ Profit In Rural Land Expropriation In China

In recent years, with the speed of urbanization and industrialization is accelerating, China entered her rapid economic development period, and there is a larger and larger demand of construction land. At the same time, there has been a serious of problems in the process of the rural land expropriation, the most serious one is that the farmers’interests is damaged, and this problem needs us to resolve gradually.The process of the rural land expropriation is actually the distribution of rural land interests among the participants, and this process contains interweaving and conflict of every participant’s will and behavior. Therefore, the reasons of causing damage to the farmers’interests in the process are in many aspects.Based on the status of the rural land expropriation in China, in this paper, the author regards that during the rural land expropriation; the damage to the farmers’interests is the most serious problem and needs us to resolve gradually. Then, the author takes the farmers of B village in Shanxi Province as the main object of study, and analyzes how much the farmers’interests is damaged during the rural land expropriation. After that, the author analyzes the reasons which caused damage to the farmers’interests during the rural land expropriation comprehensively and thoroughly, and thinks that in addition to the weak legal protection for the farmers’interests and the limiting factors from farmers themselves, the reasons which damage the farmers’interests the most seriously are to follow some unreasonable arrangements in the planned economy period during the rural land expropriation, and the local governments scramble the rural land interests with farmers. Finally, the author tries to put forward the ways to protect the farmers’interests during the rural land expropriation.China needs the countryside. Keep expropriating the rural land to build country blindly will not only speeds up the disappearance of the countryside, but also causes both material and emotional damages to the farmers who has made a great sacrifice and contribution to national development. In the author’s opinion, the primitive accumulation of wealth in China has been basically completed, we should stop keeping the discriminatory rapid development at the expense of rural farmers’ interests. The time is ripe for putting the farmers’ interests in the first row. We should stop to "have a wait" and "clear a way":wait the existing cities become healthy, perfect, and have enough tolerance ability; clear a way for the farmers’ interests in the subsequent development and construction; waiting for farmers willing to leave rural land and can integrate into the city; let the farmers can still live with dignity after transferring their rural land. Only in this way, the country can realize the comprehensive, coordinated, sustainable development.
