Trade Barriers Of Inteernational Service Trade And The Legal Countermeasures Of China

One of the important index to judging a country’s economic development is the growth of the tertiary industry of the country, that is to say, the addition rate of service sector in its economic development. Our country,as a trading power one in the world, has got a relatively advantageous position in goods trading. The existence of various barriers in services trading and our own low technical level,the lack of relevant systems are all the reasons, which lead our country a disadvantage position in services trade market.As a new thing in international trade barriers,the relevant legal research of service trade barriers in our country is still not deep enough. With the development of international service trade in China, shortages and defects of the existence theories and system are also apparent increasingly. How to solve these problems is not only related to the future prospects of the development of international service trade in China,but also provides a new starting point in our country and its legal countermeasure research of the international trade in services for comparing the influence of foreign trade in this paper. Learning from foreign legislation’s experiences and shortages and combing the currency of the of international service trade barriers’development trend, we need to build the build the relevant law system in our country and to provide the necessary reference for related legal policy.This paper tries to analyzing the formation and development of international service trade barriers,and fully understanding and analysis the influence of international service trade barriers to our country’s foreign trade,especially in the aspect of legislative,judicial,law enforcement feasible measures and countermeasures. This chapter the analysis the content through the two convention effect,and the two convention since the effect was evaluated.The third part introduces the concept,types,characteristics of international service trade barriers,and analyzes its future development trend.The fourth part mainly discusses the U.S. trade barriers to trade relief system and the European Union regulations, and through the content analysis of the causes of international service trade barriers, judge implementation products are exported to Europe and the United States for our services is legal service trade barriers, and Europe and the United States this brief impact on foreign trade of our country.The fifth part through the above analysis and expounds the construction of related system of our country in the future especially legal countermeasures proposed own some views and opinions.
