After global financial crisis, America’s economy fell into recession. But what is different from that is the boom of the economy in the Asia-Pacific region. In order to promote the recovery of its economy, America announced to participate in the trans-pacific strategic economic partnership agreement(TPP) which established by the Chile, Singapore, New Zealand and Brunei in 2009. Quickly America hold a dominant position in TPP negotiations and persuades other countries to participate. Until now, TPP has launched eighteen negotiations and has gradually expanded its influence. TPP has not yet formally announce its official text, but according to a draft published in 2010, TPP agreement is a complex of vast of space, a high standard of content, openness of entrance system and trade liberalization. These characteristics discouraged many countries from the Asia Pacific region. So far, the TPP includes 12 member countries from different region. China had never been invited to join in. The zero tariff in TPP will promote the trade cooperation between countries within this region, and increase their trade quantity, and then develop their economic. On the opposite, countries outside TPP will miss the chance to cooperate with countries within TPP, which will lead to reducing the amount of international trade.China hasn’t received the invite from America and hasn’t tended to participate in TPP. Therefore, as a non-TPP member, China also faces affected by the trade diversion effect on the country’s foreign trade bringing by TPP. How to alleviate and even eliminate the TPP impact and influence on China’s foreign trade, has been important issues researched in political, economic and legal. This article described the process and characteristics of TPP, enumerated main terms of TPP, and compared it with APEC and WTO in order to understand the tendency of TPP in depth. Then discuss the effect of TPP on China’s trade based on this fact, and puts forward the legal ways of comply with China’s national conditions, which is to pay close attention to TPP development, continue to promote the development of FTA, promote the development of the RCEP, improve the labor and environmental standards at the same time, improve the international competitiveness. In this way, China can deal with the effect and challenges brought by TPP easily.
