In the 21st century, human beings realizing the sustainable development of the economy and the society are both critical challenges. Consequently, many countries are actively developing new energy technology with different methods. Due to features of solar energy such as safety, public health and sustainability, the most of developed countries has treated developing and utilizing solar energy as a long-term strategy. After years of exploration and practice, the photovoltaic industry is stepping into golden time. However, the rate of European economic development speed is slowing down as a result of Sovereignty debt crisis and the loan crisis of United States, which leads to less demand for a huge supply of photovoltaic products. And then, most European governments cannot afford the huge subsidies because lots of European photovoltaic enterprises are faced with business crisis or even bankruptcy. After the second half of 2011, photovoltaic industry has begun to enter a bottleneck period. In order to transferring loss and risk for rebuilding EU economy, the countries began to practice trade protectionism and arbitrarily use the trade remedies allowed. The anti-dumping measures as a traditional protectionist measures is widely used in international trade. The EU has lodged a series of anti-dumping probes against photovoltaic products imported from China in July 2012. The amounts (20.4 billion dollars) is broke the record of global trade disputes. This accident is bringing a great strike to the Chinese photovoltaic enterprises, which not only leaded the enterprises suffered huge losses but also damaged social welfare deeply. The article has described systemically the theory of dumping and anti-dumping and reflected based on a large volume of data. The article also adopts SWOT to analyzing photovoltaic industry and investigates the reasons and effects of EU using Anti-Dumping to against China. According to the above analysis, finding ways to prevent and deal with counter-dumping.By reading a lot of foreign literature, and the foundation of theory of trade protection, trade remedy system under regional agreements, game theory and the effect about anti-dumping basis, made a deep understanding for anti-dumping theory research methods, processes and findings. Secondly, the EU and China combined with the actual conditions of the reasons for anti-dumping investigations were qualitatively analyzed. Finally, icons, and data analysis by the effect of anti-dumping, anti-dumping actions have drawn significant effect of trade restrictions, trade diversion effect, trade deflection effects and inhibitory effects of trade and industry chain will cause responsive anti-dumping.This article first-dumping, countervailing concepts and types of sources of law and legislation, Antidumping conditions make the system described, from state of the global anti-dumping, China suffered overall anti-dumping investigations, a number of angles national distribution and product structure shows that China has become a dumping of the hardest hit. On the basis of SWOT model, from the needs of the photovoltaic industry, investment analysis of photovoltaic elements, the prospects for the photovoltaic industry and photovoltaic industry competition pattern, made analysis of advantages and disadvantages of PV industry chain. Combined course and development of photovoltaic industry development status of China, noted that large-scale exports of Chinese PV industry, backward production technology, export-oriented approach to the processing trade and industry highly concentrated, low capacity utilization.The investigation of EU anti-dumping to Chinese PV products is peaceful settled by the price of commitment, but the event made a negative impact for both trade and society. EU’s anti-dumping to Chinese PV products not only because of the arrival of the post-crisis era, but also by the EU’s strategy and discriminatory policies to China.Finally, for the prevention of anti-dumping investigations in the future, and to deal with anti-dumping cases, there are some suggestions for the government, industry associations and enterprises. Government should improve relevant laws and regulations, and further clear division of investigative agencies, to develop the domestic market, and promote industrial development investment and financing mechanism, etc; Industry Association member units should coordinate relations and built the work of information consulting, and participate in the development of industry standards actively; each enterprise should be combined parties to seek foreign aid, increased technology, expand their horizons to the globally markets.In addition, the incident manufacturing exports to China also has some implications, including the importance of international trade rules, the use of reasonable laws and regulations to protect their legitimate rights and interests; foster innovative corporate culture, increase product research and development; the government’s long term planning, timely guidance.
