Study On The Farmers’ Compensation Of The Water Conservation Based On The Farmland Requisition

Along with our country intensify protection of water resources, implementing blocks to protect water resources gradually. All production activities have been banned in the primary reserve, and involving farmland will be all in requisition; In accordance with the relevant policy, some production activities are restricted in the secondary reserve and prospective reserve. Surrounding farmers have lost farm land and the benefits based on the development rights of land in order to ensure the security of water quality in the area. At the same time, the downstream gains benefits in production and living because of safe water. Due to water area is relatively poor, the contradiction between economic development and water protections becoming more and more prominent in the area. Therefore, studying the moderate compensation level of land expropriation in source area, giving reasonable compensation to related interest groups is conducive to relieve the prominent contradiction of environment and development, the dispute between different regions, different interest subjects,it has very important practical significance.Paper, after studying the existing theory about the compensation standard of land requisition, on the basis of Dahuofang reservoir and downstream area as the study area, based on the income and payments will investigation to the surrounding farmers, combined with the willingness to pay(WTP) of the downstream, considering reservoir under the premise of ecological and economic sustainable development, building the land compensation mechanism meeting the demand of development in the study area. The research content and results are as follows:(1) Study to determine the upper and lower on land compensation of Dahuofang reservoir. Determine compensation subject, compensation object and the compensation standard based on the stakeholder theory. Study to determine the upper and lower on land compensation. The lower compensation limit: don’t consider the appreciation income of farmland development rights of the landless farmers losses(cost), the upper compensation limit: consider the appreciation income of farmland development rights of the landless farmers loss(cost), determine the compensation standard should be set in upper and lower limits of the reasonable range. By the survey of damage of surrounding residents, analysis and process data, and determine the lower compensation limit is 1240. 4yuan/ mu; Through the data research of economic development in surrounding similar areas, determine the upper compensation limit is 2575.98yuan/mu. Considering whether to perform the township government subsidy cases, land requisition compensation gap in the range of [-359.6, 1493.4], thus eventually determine the amount of extra compensation is 993.4yuan/mu.(2)Based on the analysis of the basic theory and main content of farmland compensation mechanism, considering the practice of Dahuofang reservoir, discuss the payment and allocation of compensation in detail. To determine the main body of payment are enterprises which investment and department in the water reservoir, the downstream, residents who use the electricity, aquatic products breeding farmers and tourists, without considering the government departments. The main body of compensation are landless peasants and ecological environment protectors surrounding the reservoir. In the research of the share rate of compensation, considering three factors comprehensively including the degree of benefit which main body enjoys, the willingness to pay and ability to pay, then calculate respectively the rate of payment among enterprises which investment and department in the water reservoir, the downstream, residents who use the electricity, aquatic products breeding farmers and tourists are 0.6225, 0.2006, 0.0304, 0.2006 and 0.0304, the share of farmland compensation amount are 618.40 yuan, 199.33 yuan and 30.17 yuan, 30.17 yuan and 95.55 yuan. In the research of compensation configuration, take the loss and weight of landless farmers and ecological environment protectors surrounding the reservoir into consideration comprehensively, then calculate the compensation allocation ratio are 0.8855, 0.1145, the share of farmland compensation amount are 879.66 yuan and 113.74 yuan respectively.(3) Reference other successful experience at home and abroad, according to the actual situation of Dahuofang reservoir, put forward corresponding compensation ways and measures. Then explains the feasibility of the compensation mechanism from the money affordable, technical and administrative aspects.
