Improvement Of Rural Land Requisition Compensation System Study

With the rapid development of China's urbanization and industrialization, a large amount of rural land has been expropriated, at the same time, producing a large number of landless peasants,also leading to a series of violent actions or behaviors in the process of land requisition. Land conflicts have become increasingly prominent, seriously affect the relationship between cadres and peasants and even endanger social stability. The Party Central Committee has always paid attention to solving the problems facing agriculture, rural areas and farmers. In 2008, the Third Plenary Session of the seventeenth Central Committee made clear demand for further reforming the land compensation system, and asked to regulate rural land compensation system. How to promote the development of urbanization and industrialization, meanwhile lay down practical land compensation system to protect the interest of landless peasants,which involves China's social stability and builds a socialist harmonious society.In this paper, first begin with defining the concepts of land requisition, land compensation, property and land property rights and so on, then introduce the land price theory, land compensation theory, new public management theory. This paper provides an overview of domestic and foreign scholars'views on the land compensation system, and learns from both at home and abroad, especially foreign countries. This paper uses comparative analysis method, combining static and dynamic analysis methods , combining theory and policy analysis method to analysis land compensation system in different historical periods in China, especially current land compensation system, then point out the problems, the results and analysis the causes of the problems. How to solve China's rural land compensation system problems, previous research mainly lies in raising the compensation standards, standardizing compensation procedures, ascertaining land property rights and so on. This paper mainly starts with the government functions'point of view on the base of improving problem-solving measures above, and rationally positions government functions and regulates government'land requisition behavior in accordance with "balancing the interest of society, providing public service, protecting vulnerable groups", and finds out the role that the government plays in the requisition of rural land. Highlight the diversity of compensation for the landless farmers, especially intensify the efforts on job training for the landless farmers, and create social security system to alleviate the landless peasants'worrying, ensure the interest of the landless peasants fundamentally. This article seeks to explore from these aspects, and puts forward some measures to improve China's rural land compensation system.
