With the development Chinese new urbanization and the rapid development of rural land circulation, the majority of farmers rights and interests of the demands of the homestead right of use is no longer confined to meet their living, the land using right of capital property demand is growing. As a result, farmers private hidden transfer homestead phenomenon is often seen. With our current rural land and circulation legislation seriously lagging behind, the relevant provisions is mainly to policy documents, so the effect of the level is not good. Especially the current homestead transfer market is not perfect, management is not standardized, which restricts the development of rural society and economy. As the Third Plenary Session of eighteen mentioned, to reform and improve the rural homestead system, explore new channels to increase farmers’ income from property, which have made the countryside homestead right of use circulation problems becoming the focus of the whole society.Under the Marx’s property right theory and the hypothesis of "rational man", optimize the allocation of resources theory, this study sums up the history since the founding of the countryside homestead right of use change, analysis the cause in the context of new urbanization that promoting the circulation of Homestead Land use right, focuses on the analysis of internal and external factors which influence the circulation of homestead farmers. At the same time, it combined with the field survey data of Xinyang City, the analysis of the present situation, problems of local land transfer, based on the Logistic regression model and the factors affecting farmers willingness to transfer the right to the use of land in order to make the results.Through the research, the author believes that our current laws on rural land circulation have not meet the needs of the market economy. China is in an important period of the construction of new urbanization, which is a great opportunity for the reform of rural land use right transfer system. Putting forward the reasonable transfer of the right to use rural homestead, can effectively connect cities capital, financial capital and assets of farmers, which can help farmers to create a capital property and promote the construction of urbanization. Relevant survey data show, some farmers in Xinyang has been showing the circulation of the use right of homestead will. But because the farmer right consciousness is not clear, transfer procedures are not standard that caused the current homestead transfer ratio is not high, extensive use of rural residential land transfer phenomenon is serious, this is still in a covert、illegal and unregulated state. The research puts forward the following suggestions: strengthen the countryside homestead right of use circulation system construction of legislation, clear the legal nature of the right to the use of homestead, clearly define the transfer conditions, scope, form, explore homestead compensation system; Establish a standardized and orderly land property rights to use the transfer market, establish a reasonable land price system and distribution mechanism; improve the rural social security system; strengthen the planning management and supervision of the circulation of rural homestead.
