Since the reform and opening up,China's economy is witnessing a rapid development,and urbanization process is accelerating,and people's living standards are getting higher and higher.However,with the process of accelerating the process of urbanization,there are some phenomena: large numbers of t rural people flocked to urban for working or life,which turning the rural into a "hollow village".Rural population is less and less,and the farmer's house whose is moved to the urban became empty houses.At the same time,it is precisely because of the large numbers of rural population moved to the city,resulting in urban land tension,housing prices continue to rise.In such a large network intertwined,rural homestead-land-use-right' "invisible trading" market is producing.However,the right to use homesteads in our country is legally prohibited,so that illegal trade is restricted,and judicial disputes are also produced due to illegal transactions.In addition,due to the bad land management,which made rural homesteads indiscriminate occupied and over occupied by farmers,resulting in a large number of homestead resources waste,and this phenomenon is often can be seen.In this context,this paper proposes to change the current system of the rural homestead-land–use-right,and establish homestead-land–use-right transfer marketFirst of all,this article uses the literature Inductive method,in the case of analyzing and summarizing a large number of documents,talking about whether the homestead-land–use-right can be transferred and how to transfer.And on this basis,I defined the relevant concepts and explained the relevant theory.Then,this paper analyzes the formation momentum of the market of transferring the homestead-land–use-right,and lists the three modes of the current development of the homestead-land–use-right,that is,a few and conditional legal circulations,illegal "private" circulation,provincial reform pilot flow.Through the analysis of the status,this paper summarizes the dilemma in establishing the homestead-land–use-right transfer market: lack of micro-market and "failure" of macro-control.Through the comparison and analysis,the vertical comparison of several more classic homestead use rights pilot practice,introduced the pilot practice of specific practices or operational procedures,in the analysis of the pros and cons of the practice of the pilot,put forward a general Revelation: market circulation is the trend,the right to prove the premise is that the two means to play a common role.In this paper,I use the game analysis method and cited two cases,through the case of homestead use rights transfer market behavior of the main analysis,and one is the behavior of the government when the main choice of land acquisition,the other is the free flow of the main body of the strategy of choice.There is also a risk-based behavioral strategy choice.Finally,according to the different game content gives the conclusion.This paper uses the system analysis method from the micro-market(set the threshold of the market,define the main body of demand and supply the main body,provide a market trading platform,etc.),macro-government regulation and management(economic means,administrative means,legal means),risk prevention and control(prior control,control in the matter,after the control)three aspects of the system introduced the establishment of the right to use the right to transfer the market.
