A Research Of Mechanism To Improve Land Joint Law Enforcement In The Perspective Of Holistic Governance

Land law enforcement in land and resource management in a very important position, it bears responsibility to combat illegal land occupation, prevent the loss of land assets and the maintenance of national land management and land market order. But, in the current complex social situation, the specific administration action violated the law is not only break one law or a regulations, but involved many policies. At the same time, the fragmentation trend of government management has become more and more serious, the executive branch and their duties are so detailed that a branch only can do its own part in an illegal act under the administrative competence, that results the law enforcement can’t carry on smoothly, Land law enforcement, too. In this context, the "holistic government" may be a good solution to this phenomenon and was highly valued by kinds of administrative departments for law enforcement. Also been praised by the Department of land management. However, our country current government institution and governance model has not changed, the confliction of administrative competence caused by the administrative authority fragmentation still exists, the land "jointed law enforcement" only partly worked did not completely solve the problems. Founded on the theory of holistic governance and used the core ideas and points of the theory, my research combined with the actual situation of the institutional structure try to propose strategic insights and recommendations to the governance’s theory, organizational structure, operating mechanism and the form of service, etc. I hope my advice would overcome the confliction of the legally specified limits of authority which was caused by fragmentation of the management mode, and provide a reference for improving the way land joint enforcement mechanism.
