Analysis Of Land Conflicts In The Process Of Urbanization

Land conflicts are important forms of social conflicts in the process of new-type urbanization during the transition Chinese society. It directly affects the stability and development of Chinese society, and affects the successfully transformation of our society from traditional society to modern society. From the perspective of empirical research, use the theory of social conflicts, and according to the context of interests-power-rights-institution, this paper study the problem of land conflicts in the process of urbanization, and take Min village expropriation conflict in Shanghai as a special example. Thus carry out a deeply research on the general situation of this expropriation conflict, the various stakeholders in the process of land conflicts and gambling relations between them. Explore the causes of the conflict, and found out four main causes below:First, the interests sorrow of land compensation and resettlement:non-public of compensation and resettlement policies, standard disconnected with the market, time lag, and unclear of main responsibility; Second, the power boundary of government behavior norms:weak right of villagers VS strong power of government, procedures anomie, government blame, and insufficient ability on conflict management; Third, right trouble of villagers’social security:social security system is not sound, none implementation of basic life safeguard, no guarantee about unemployment and employment, and without welfare for children and elderly; Fourth, the defects of land ownership system:unreasonable of land property right institution, defined ownership rights, unclear of land property rights, improper limits to land property rights; Thus find out the developmental process of land conflicts and fact logic. Finally explore the effective resolution path and suggestions to land conflicts, and suggest six institutionalized mediation path:improve the system of land compensation and resettlement, perfecting the relevant social security system, standardize the procedures of administrative examination and approval mechanism, keep the letter petition system and interest expression mechanism open, complete conflict early-warning management mechanism. Through the analysis above, I hope to provide some reference of adjusting land policies and the relations coordinating between the parties for the relevant government departments, to provide guidelines of behavior regulating of main participation objects in the process of land, land conflicts reducing, farmer’s legitimate rights and interests maintaining, to provide reasonable guidance methodology for efficient management of land conflicts, and provide effective support to country’s urbanization construction and the construction of a harmonious society.
