With the development of economy, traveling has been a new choice for thepublic; however, it is the increasing rise of the entrance fee of many scenic spots thathas seriously damaged to the rights of tourism customs. The increasing entrance fee ofscenic spots is not the properties of public product and public service, but the platformfor local government and relevant departments to obtain local and departmentinterests, what is more,“dependence of the entrance fee” is played in some places.The more and more strong “economy” factor has caused many difficulties andtroubles, such as improving service conditions in scenic spots, developing theindustrial extension and so on. All of these have made that the tourism expansion andsustainable development become very difficult. Therefore, it is very necessary for ourgovernment to establish a reasonable mechanism for protection of tourism scenicspots resources and the entrance fee of these places. Through these legal regulations,we can guarantee the reasonable price of scenic spots, transparent act of priceadjustment and the balance of social benefits and economic benefits.This study contains four parts.The first part puts forward the problem of “excessive” entrance fee of scenic spots bytypical cases, including “the rise of entrance fee in Shandong Jinan Lingyansi” and“‘the new form of price increases’ in Hunan Xiangxi Phoenix Ancient City”. Inmanagement process of scenic spots in our country, there is a strong commercial andweak public tendency which has greatly damaged the interests of traveling customs.The legal regulation is not adequate in the price of scenic spots. The legalresponsibility is not clearly divided and the responsibility is confusion among theprice supervision department in scenic spots, the manager of scenic spots and theenterprises with permission to manage the tourism development.
