A Study On Dealing With "Double-Reverse"　Investigation For China

Since entering the new century, China’s foreign trade has obtained fast development. However, as the integration of global economy accelerates and the deepening of China’s integration into the global economy, China’s foreign trade is also facing a new challenge. The outbreak of the2008global financial crisis has exacerbated the market demand and caused economic stagnation and even regression, making the development of international trade in haze. Under the background of instability of the world economy increase, trade protectionism is rising. In order to protect their own industries from damage, governments seek to trade remedy measures. The "double-reverse" investigation is favored by most of countries because of its great influence and difficulty of response. As a global trade power with high trade surplus which China has maintained for many years, it’s naturally China has become key goals of the "double reverse" measures for many countries. By August15,2014, United States, Canada, Australia and the European Union and other countries and regions has launched more than seventy "double reverse" investigation for China’s iron and steel products, chemical raw materials, construction materials, mechanical and electrical machinery, etc. Most of them are implemented "double-inverse" measures. Frequent "double-reverse" investigation causes a huge impact in many aspects to our country.Therefore, in the new international economical situation which changes frequently, comprehensive and systematic research for "double-reverse" issue is of great importance. Based on this specific background, this paper makes the in-depth analysis about the status quo and characteristics of our country’s facing the "double-reverse" investigation through qualitative and experience analysis, summed up the reasons and influence for China’s been launched "double-inverse" investigation frequently by other countries, and try to put forward scientific and reasonable suggestions for our country when dealing with "double-reverse" measures.This paper is divided into seven parts:The first part introduces the research background and significance of this paper, analyzes the research status of the anti-dumping, anti-subsidy and "double-reverse" issue both at home and abroad, finally explains the research methods and thesis structure of this paper and also points out the innovations and shortcomings of the research. The second part expounds and analyses the research object of this article, including the concept, characteristics, launch conditions, legal basis and the general procedure in practice of "double-reverse" investigation, set the theoretical foundation for the following research.The third part analyzes the status quo of our country’s suffering "double-reverse" investigation. Through research for all the "double-reverse" investigations China has suffered during the recent ten years, it finds that almost all of these "double-reverse" investigations come from the United States, Canada, Australia and the European Union, and presents the characteristics of involving countries and products are relatively concentrated, the "double-reverse" tariffs are different and response to "double-reverse" investigation is more difficult.The fourth part analyzes the reason for our country’s suffering "double-reverse" investigation frequently. This paper considers that the internal reasons of our country’s suffering from "double-reverse" investigation frequently lies in unreasonable subsidy policy of our government and the dumping behavior of enterprises, the target market of export products is relatively concentrated, our country give up the special and differential treatment for developing countries and most enterprises do not response to "double-reverse" investigation actively. The external reasons are mainly caused by huge trade surplus, the global financial crisis; Importing countries amend their countervailing law and the characteristics of the "double-reverse" investigation.The fifth part analyzes the influence for our country’s suffering "double-reverse" investigation. This paper considers that "double-reverse" measures may bring great burden to our government and enterprises, weaken the competiveness of our country’s export products, hinder the implementation of the our country’s macro-economic policy, it may even cause industrial chain effect and "flock effect".The sixth part puts forward counter-measures dealing with "double-reverse" investigation for our country from three aspects including the government, industry associations and enterprises on the basis of above analysis. Our government should improve our country’s trade remedy system and subsidy system and make full use of WTO dispute settlement mechanism; Industry association should complete the "common coping mechanism", set up trade remedy fund and cultivate specialized talents for responding "double-reverse" investigation; Enterprises should be prepared in advance and respond to "double-reverse" investigation actively, optimize exports products competition strategy, and make full use of the judicial review system.The seventh part summarizes the content of the full paper.
