Study On Township Government Harmonious New Urbanization Construction In The Process Of Land Expropriation

Along with the development of China’s urbanization, urban scale expands unceasingly, thus needs to collect a lot of rural land. Land expropriation is a policy made by government according to the approval authority and procedure law to meet the need of the social and public interests. It turns Land collectively owned by peasants into the state owned land and give compensation to farmers collective and individual. The land is not only a non-renewable resource, but also a material foundation to the survival of humans; therefore great attention has always been paid by the people. With the continuous development of social economy, part of the land expropriation policy has not adapted to the current needs of the development. At the same time, problems exist in particular project:land expropriation procedure is not appropriate; compensation and resettlement is not in time; the implementation is not standard; Process is not public enough. Thus violated the legitimate rights and interests of people and leaded to some mass petitions. Then how to balance the interests of the farmers and government in the grass-roots level and achieve a win-win and harmonious land expropriation? The author’s suggestions are the following aspects:Firstly, we should make a classification system of land expropriation, and regulate the behavior of land management with strict enforcement of the policy. Secondly, we should come up with a flexible way of land resettlement, and a scientific and comprehensive standard for compensation to strengthen the land-lost farmers’ social security and protect their legal rights and interests. Thirdly, we should complete the mechanism of land expropriation and construct expropriation team to make sure their harmonious expropriation behavior, and help the execution of land expropriation policy and properly dealing with land disputes。...
