The Study Of Government Misconduct Issues In Land Expropriation And Housing Removal

In recent years, our country's urbanization level enhances unceasingly, the population urbanization rate already from 1993 to 28% increase 43 percent in 2005. Urban development will inevitably requires more land for construction purposes, the urban land has basically be exploited conditions, large quantities of rural land became the new development plan. Owing to the increasing demand for land, resulting in more rural collective land requisition, more and more farmers'houses be demolished. The land expropriation and housing removal provides abundant land supply for urban development, but the unreasonable forced demolition also has caused the frequent contradictions and disputes.Currently, the problems existing in the land expropriation and housing removal has been widespread social concern, become one of the hot issues. These problems are caused by many factors, not only the government's responsibility, but also farmers'responsibility. But the government as the leader of the land expropriation and housing removal, the behavior of government in the land expropriation and housing removal has more effect. Because of the contradictions and disputes, the land expropriation and housing removal was nicknamed "number one indeed difficult".In reality, many local governments in the land expropriation and housing removal ignore the national laws, the phenomenon of illegal land expropriation and violence housing removal exists generally. For instance 2005 in Hebei province violence land expropriation and housing removal incident, the government does not have relevant land requisition formalities cases, confiscation, by the villagers strong resistance, the government staff and farmer happened gratifying, killing six people and dozens injured. There are still a lot of government's bad behavior, for instance, the farmers cannot completely implemented; in land expropriation and housing removal, some local governments reduce compensation standard in order to reduce costs, neglect or disregard for the dismantlees life settlement; and the local governments with all sorts of reason in arrears, misappropriate, embezzle part of compensation, etc. The government's abnormal behavior not only damaged the interests of farmers, but also leads to the conflict against the government, undermine the image of the government. The land expropriation and housing removal relates to the farmers interests and economic development, if processes is not good, it will affect the whole social stability.This paper starts from the land expropriation and housing removal and adopts case analysis method, through three different types cases, summarizing the manifestation of government abnormal behavior, such as violence relocates, non-standard procedures, low compensation standard, unqualified resettlement work, etc. Also, according to the institutional economics entrust-agency theory, public choice theory and system influence behavior theory, this paper analyses the reasons of government abnormal behavior. In the system of the land expropriation and housing removal from abroad on the basis of norms of government action proposed countermeasures systems.The government is the leader in the land expropriation and housing removal, the government's abnormal behavior have caused a large number of contradiction, disputes, therefore, regulating the government behavior and reducing the government abnormal behavior is important for establishing harmonious society and a good government image.The innovation of this paper is to use a multi-case analysis method, making the analysis of government reasoned abnormal behavior; and select the public choice theory, cost-benefit relationship between theory and system theory and behavioral analysis of the reasons for government misconduct, analysis of the causes no longer stay on the surface, but the misconduct of the government deeper reasons.
