A Study On Problems And Countermeasures Of Petition Letter About Land Expropriation And Removal In A City (G)

With the sustained and rapid development of the current economy in China, the problem of removal caused by the land expropriation became more and more serious. Because all kinds of contradictions in land expropriation and removal were complex, and Land Management Law, whose relevant content was not detailed and completed, has not adapt to the requirement of the land expropriation and removal in China. Therefore the work of land expropriation and removal was facing unprecedented challenges, and there were some urgent problems needing solving to some extent.The paper, which was divided into three parts, presented the systemic analysis on the situation of the land expropriation and removal in a city G. The first part was to introduce the concepts of land expropriation and removal by literature review and state the mechanisms on letters and visits. The second part concluded the situation of petition letter about land expropriation and removal in G by statistical analysis and case analysis, including analyzing the situation, existing problems and their reasons. There were five main aspects in existing problems:the secure setting after land expropriation, the unequal distribution of land expropriation compensation, the compensation distribution to special groups, the broken promise of land expropriation compensation and the repeated petitions caused by other subjective reasons. The main reasons were the lack of legal education to people in low class, the insufficiency in attention and cooperation from relevant departments, the underdeveloped reports information of network and the nonscientific management without innovation. The third part, the key part of the whole paper, proposed practical and operational countermeasures of petition letter about land expropriation and removal in G City. The countermeasures included perfecting the security measures by making every step in land expropriation public, setting strict standard of compensation in order to make the public convinced, offering a special treat to special groups so as to avoid the conflicts, and preventing repeated petition by revisiting the petitioners.The innovation of this paper, which recited the actual situation of land expropriation and removal in G as the breakthrough point, was to research the causes and countermeasures of petition letter about land expropriation and removal in G, so as to provide the suggestions and methods for resolving the contradiction in land expropriation and removal in China and to offer theoretical reference for formulating relevant laws and regulations.
