Research On The Problems And Countermeasures Of Collective Land Expropriation And Demolition

At present,with the development of urbanization,the scope of cities is extending to suburbs and countries.Because of this,more and more collectively-owned lands are imposed into state-owned construction lands.During this process,as it refers to many interests and the unfair arrangement,the contradiction is more and more serious.It also becomes the main reason of society contradiction.Based on the facts,making the land expropriation and demolition fluency and the society harmonious is quite necessary.It's time to deal with the key problems which appeared in land expropriation and demolition.This paper adopts literature research method.Based on the study of scholars at home and abroad,this thesis collected some key problems about land expropriation and demolition,such as the unclear definition of public interest,the abuse of the right of land expropriation,the low compensation standard,the unreasonableness of land income distribution and non-standard procedure.The reasons of causing the key problems are including faultiness legal system,dislocation of government roles,shortcoming of supervision and accountability system.Based on the theoretical analysis,the author takes New East Station for an example and analyses the policies related to the compensation and settlement.The land-lost peasants are conducted questionnaire survey.Through analysis of questionnaire data,the author finds a way to solve the problem and provide the experience to other areas of land expropriation and demolition.Firstly,perfect system construction of land expropriation and demolition,including land property right system,the explicit laws and judicial remedy system.Secondly,make scientific and reasonable compensation and settlement system,including compensation standard consistent with market terms and diversified compensation and settlement way.Finally,the government must play the right role to make scientific compensation and settlement policies,to define the public advantages and execute the procedure justly.Also this thesis makes some expectation of the future land expropriation and demolition.I believe that with the joint efforts of all parties,the problems of collective land expropriation and demolition will be solved step by step.The land-lost farmers will fully share the development dividends brought by the land,and the urban development will be smoother with land expropriation and demolition,and our whole society will be more harmonious and stable.
