The Research On The Protection Of The Rights And Interests Of Farmers In The Development Of Chongqing Modern Agricultural Park

The central government has released the annual "No 1 Central Document" every year focusing on agricultural modernization since 2013. Agricultural modernization aims at ensuring agricultural supplies, increasing farmers’ incomes for sustainable development.Deepening rural land system reforms is the basic motive force for sustainable development. It has been proved that the system of rural land circulation and modest scale management is the only way to realize the development of agricultural modernization.The rural land system reformation could be divided into three stages which includes the administrative allocation of land, the distribution of land circulation and quasi marketization of land. In the early years of China land reform was carried out which aimed at realizing the land to the tiller. According to the land reform the ownership of land was fairly allocated. In the late 1970’s equal field circulation occurred to emphasize on the per capita possession of land. Quasi marketization of land emerged as the times require. And now the new connotation is integrated into the system of rural land circulating in new conditions. We have to lay equal stress on fairness and efficiency in the process of optimizing the allocation of land resources and rural-urban integrated planning. The farmers should be conferred on more powers and the rural-urban resources should be equally exchanged and allocated. The farmers should be allowed to participate into the process of modernization and share the achievements of modernization. So the land circulation bridges the development of agricultural modernization and the farmers’ rights.In the point of property right theory, the paper takes the Chongqing Jiangjin Modern Agricultural Park for an example. It puts research on how to protect farmers’ land rights onthe base of land circulating. It defines the connotation and constitution of the land circulation and the farmers’ land rights. By investigating the development of the Agricultural Park and the characteristics of rural land circulating, the problems and the effects even the reasons of guaranteeing the farmers’ rights are emphatically analyzed in terms of rural land contractual management right, right of land disposal and earnings, policy supervision and sustainable development. It puts forward suggestions and solutions to the realistic problems.It indicates that the development of modern agricultural park is based on the security land rights of farmers. We have to make much account of protecting farmers’ land rights. It could be achieved by the ways of ameliorating the system of land circulation, innovating the way of land contract, reinforcing the ability of protecting farmers’ rights, increasing benefit,strengthen supervision of and services and innovating the new ways of contract management so that a win- win strategy of harmonious development of farmers’ life and the Modern Agricultural Park could be realized.
